10. Limitation of Liability

Even though Leven Vision has taken reasonable commercial steps and efforts to prevent your Personal Data from being accessed, used, intercepted, or disclosed by unauthorized individuals, you agree and acknowledge that Leven Vision cannot fully eliminate security risks associated with your Personal Data. You expressly acknowledge and agree that uploading, storing, transmitting, sharing, and/or allowing access to Personal Data and other information through our platform and/or other channels, and the use of our Services, are all done at your sole risk and responsibility.

You expressly agree and acknowledge that, except to the extent expressly provided for in any services agreements, Leven Vision is not liable for (i) any indirect, consequential, or punitive damages arising out of or resulting from your use of our website and/or platform or (ii) any loss, disclosure or use of your Personal Data or other information.

Addendum: ParaScout LIVE Participation & Specimen Submission

This section applies specifically to users who participate in the ParaScout LIVE session and submit physical biological specimens for analysis.

1. Specimen Anonymization and Safety

1.1. By submitting a specimen, the Participant (Laboratory or Institution) warrants that all samples are fully anonymized. No Protected Health Information (PHI), patient names, or identifying labels may be present on or within the specimen.

1.2. Leven Vision does not accept, process, or store any Protected Health Information (PHI), patient names, or identifiable health data.

1.3. Any specimen received with identifiable patient information or safety concerns will be refused or safely destroyed without prior notice, in accordance with laboratory safety and data‑protection procedures.

1.4. The Participant certifies that all submitted specimens are chemically fixed (e.g., in formalin) and rendered non-infectious. Leven Vision reserves the right to refuse and safely dispose of any specimen that appears to pose a biological hazard.

2. Ownership, Retention, and Disposal

2.1. By default, submitted slides or specimens are not returned to the sender. If a return is required, it must be specifically requested and agreed upon in writing prior to shipment, with the Participant covering any associated costs.

2.2. Specimens will be retained for a maximum of 30 days post-analysis. Following this period, samples will be professionally disposed of in accordance with laboratory safety protocols.

2.3. Digitized scan data from your specimen is stored on the ParaScout platform for 14 days to allow you to review and explore the results. After this period, scan data is archived for internal AI development purposes (per Section 3.1) or permanently deleted upon your written request.

3. Data Usage for AI Training and Marketing

3.1. You grant Leven Vision a perpetual, royalty-free, worldwide license to use the digitized imagery generated from your specimen for technology validation, internal research, and the training of our AI algorithms.

3.2. Leven Vision may use anonymized microscopic images and related footage for educational, marketing, or promotional purposes. During the LIVE session, Leven Vision may credit the participating institution by name if the participant has agreed to such acknowledgment in the submission form or during pre‑session coordination. No individual names or personal data will be displayed.

4. Liability and Shipping

4.1. The Participant is responsible for the secure packaging and compliant shipping of specimens according to international biological transport standards. Leven Vision is not liable for specimens lost or damaged during transit.

4.2. Analysis performed during ParaScout LIVE is for demonstration and validation purposes only. The output generated during these sessions does not constitute a formal medical diagnosis or clinical report.

4.3. Although ParaScout AI is an IVDR‑certified device, analyses conducted during ParaScout LIVE are demonstrations only. The data and outputs generated in these sessions are not intended for clinical or diagnostic use and must not be relied upon for patient management, treatment, or decision‑making. Participation in ParaScout LIVE does not create a diagnostic relationship between Leven Vision and the participant or any third party.

5. Consent to Live Participation

5.1. By registering for ParaScout LIVE, you acknowledge that your participation (including questions, comments, and specimen analysis) occurs during a live broadcast. You grant Leven Vision the right to record, edit, and publish this session.

5.2. You agree that the recording may be hosted on the ParaScout website and shared across social media platforms for educational and marketing purposes.

5.3. Leven Vision ensures that all shared content will remain compliant with patient data de-identification standards.

6. Communication & Logistics

6.1. The personal data you provide (name, institution, email, phone) is collected and processed solely for coordinating specimen logistics, scheduling the LIVE session, delivering your analysis link, and—where you later request a demonstration or commercial discussion—for communicating with you about that specific follow‑up. We will not use your contact details for unrelated marketing unless you have explicitly opted in.

7. International transfer clause

7.1. All personal data and digitized specimen data are stored and processed within the European Union. If you participate from outside the EU/EEA, your personal data will be transferred to and processed in the EU under your explicit consent at the time of submission. We apply equivalent safeguards to protect your information regardless of your location.

8. Data Controller

9. Right to Withdraw Consent

9.1. You may withdraw your consent to marketing communications at any time by contacting us at info@leven.vision . For requests to delete your personal data or scan data before the standard retention period, contact info@leven.vision . We will respond to verified requests within 30 days.
